Directive 2002/96/EC on Waste from Electric and Electronic Equipment (WEEE) and Directive 2002/95/EC on the restriction of the use of certain hazardous substances in electric and electronic equipment (EEE) were transposed to Spain’s legislation by Royal Decree 208/2005 and it was published on February 26, 2005. This rule determines the obligations and liabilities of producers of EEE and management of this type of waste, in force as of August 13, 2005. Under Spanish legislation, a producer can be:
• An EEE manufacturer (excluding OEM arrangements)
• An importer of EEE into the Spanish market
• A distributor that sells EEE with its own brand
Royal Decree 208/2005 calls for the creation of an EEE Producer Registry under the aegis of the Industrial Facilities Registry. Producers must register and provide detailed data on the amount of EEE placed on the market on a quarterly basis.
Spain’s Ministry of Industry finalized the development of the EEE Producer Registry by the end of 2005 and it started operations on January 2, 2006. Companies based in Spain may register directly or through a WEEE take-back collective scheme.Companies located outside of Spain selling directly to customers (B2C) or professionals (B2B) in that country must register through a local legal representative.
A company acting as a legal representative of a foreign based producer must comply with the following obligations:
• Register in the EEE Producer Registry
• Report on a quarterly basis the EEE placed on the market by their represented companies
• Be associated with a WEEE collective take back system
